Should Your House Have Copper or Aluminum Wiring?

Should your house have copper or aluminum wiring?  Does it matter?  During the 1960’s and into the 70’s, aluminum wiring was used in houses as the price of copper started inclining.  Both copper and aluminum have their advantages and disadvantages but according to the Consumer Product Safety Commission (CPSC): “Houses wired with single strand aluminum wire that is used for 15 and 20 amp circuits are 55 times more likely to have one or more connections reach fire hazard conditions than homes wired with copper. Jul 20, 2015″

Why is Copper Better?

Both have been used in home building.

Recently, one of my clients had an inspection done for a home he wanted to use as an investment property.  The inspector named the top concern as the aluminum wiring.  The inspector took photos of the corrosion on the aluminum wiring and mentioned how aluminum wiring, when corroded doesn’t conduct electricity well but tends to heat up and can cause a fire hazard.  Copper wiring, even when corroded, still is a good conductor of electricity.

The estimates to replace the aluminum wiring in a 1000 sq. ft. home range from $3500 to $8000 depending on the access and design of the home.  That cost may be appreciated by a home owner who plans on staying in that home for any length of time, but for my investor, that is not a cost he can convert for that home to remain a good investment.

What about Insurance?

Insurance may be more difficult to find.  Some companies don’t want to cover you if the house has aluminum wiring.  That is one more reason to make sure you investigate insurance coverage during your option period.  In the San Antonio, Texas area, we commonly have an option period that is negotiable so the buyer has time to do their due diligence.

1031 Tax Deferred Exchanges

1031 Tax deferred exchanges allow the taxpayer to sell one investment and purchase another at equal or greater value and defer the capital gain or recapture tax that would ordinarily be due upon the sale of the initial investment.

Improve the quality of your investments with a tax deferred exchange!

As a general rule, to avoid paying any capital gain taxes in an exchange, the investor should always attempt to:

  1. Purchase equal or greater in net sale price
  2. Purchase “like kind” property (must be in same classification)
  3. Reinvest all of the net equity in replacement property
  4. Obtain equal or greater debt on replacement property
  5. Title must be held in the same manner as relinquished property
  6. Use a qualified intermediary (never touch the exchange proceeds)
  7. Identify replacement property (ies) within 45 days
  8. Must acquire property (ies) within 180 days

Another equally important topic is cooperation agreements.  To provide the other party to the transaction with notice of the exchange, real estate  agents should be using a cooperation clause in the purchase and sale agreements.  With cooperation agreements in place, buyers and sellers are agreeing to cooperate with you and your qualified intermediary to complete the exchange in a timely manner.

When a 1031 tax deferred exchange takes place, it is very important that the “qualified” intermediary follow the guidelines and not be on the list of “disqualified” parties, such as but not necessarily limited to:

  1. Employee of the exchanger (within 2 years)
  2. Attorney of the exchanger (within 2 years)
  3. Real estate broker or agent (within 2 years)
  4. An investment banker or broker (within 2 years)
  5. Accountant (within 2 years)
  6. A relative
